Rental terms & conditions

Article 1 — Purpose and scope

These terms define the rights and obligations between Giuseppe Benincasa, Viale delle Serre 9, 88050 Sellia Marina (CZ), Italy (“the owner”) and any person (“the client”) booking La Villa di Peppino, located in Sellia Marina (CZ), Calabria, Italy, for a stay or a private event. Any booking implies unconditional acceptance of these terms. They apply to individuals and professionals alike.

Article 2 — Services offered

Seasonal rental of the villa by the night, day or week; privatisation of the estate for events (weddings, birthdays, seminars, hen and stag parties, shoots and filming); additional services on quotation (catering, decoration, entertainment). Stays can also be booked through Airbnb, in which case the platform's terms apply.

Article 3 — Booking and confirmation

Every request receives a personalised quote within 24 to 48 working hours. The booking becomes final upon written acceptance of these terms, payment of the deposit and email confirmation from the owner. If the deposit is not paid within 72 hours, the dates are released.

Article 4 — Rates and payment

Rates are stated in euros, all taxes included, on the quote. A deposit of 50% of the total amount is due at confirmation; the balance no later than 30 days before arrival. For bookings made less than 7 days before arrival, full payment is required immediately. A security deposit, stated on the quote, is required before check-in and returned within 5 to 10 working days after the check-out inventory, less the cost of any damage.

Article 5 — Cancellation and refund

Any cancellation must be notified in writing (email). Scale: more than 60 days before arrival, the deposit is refunded minus a 10% handling fee; between 30 and 60 days, 50% of the deposit is retained; between 15 and 30 days, the deposit is retained in full; less than 15 days before arrival, 100% of the total amount remains due. If the owner cancels, all sums paid are refunded in full, without further compensation.

Article 6 — Access and use

The client agrees to respect the agreed maximum capacity, arrival and departure times, and to return the premises clean. Smoking is prohibited indoors (outdoor areas available). Neighbourhood quiet must be respected between 10 pm and 8 am. Pets are accepted subject to prior agreement. Any defect or damage must be reported immediately.

Article 7 — Liability and insurance

The villa is handed over clean and in good working order. The client is liable for damage caused to the premises, equipment and third parties during the stay and must hold civil liability insurance. The owner accepts no liability for theft of or damage to personal belongings.

Article 8 — Force majeure

Neither party shall be held liable for a failure due to force majeure (natural disaster, fire, flood, epidemic, administrative prohibition…). The parties shall inform each other promptly and seek an amicable solution (postponement or credit).

Article 9 — Right of withdrawal

In accordance with Article 59 of the Italian Consumer Code (Codice del Consumo, d.lgs. 206/2005, transposing Directive 2011/83/EU), the 14-day right of withdrawal does not apply to accommodation services provided on a specific date. Only the cancellation terms of Article 5 apply.

Article 10 — Mediation and disputes

In the event of a difficulty, the client first contacts the owner at contact@lavilladipeppino.fr to seek an amicable solution. Failing agreement within 30 days, the client may use the European online dispute resolution platform: ec.europa.eu/consumers/odr.

Article 11 — Applicable law

These terms are governed by Italian law. Any dispute falls under the jurisdiction of the competent Italian courts, in particular those of Catanzaro, subject to mandatory consumer-protection provisions.
